INC Domain Recovery

"Our Age of Anxiety is, in great part, the result of trying to do today's jobs with yesterday's tools." -- Marshall McLuhan

Welcome to INCDomainRecovery.com. We focus exclusively on Domain Names. Recovering Domain Names from cybersquatters and other infringers. Defending Domain Names against overly aggressive trademark holders. We can also help you to buy or sell Domain Names.

If this is what you're looking for, you've come to the right place. We are a separately operated division of INC Business Lawyers. We offer a flat fee service (plus costs) for the recovery or defense of your Domain Name through a process known as arbitration. Call us for a free consultation.

Here are just a few of the ways we've been able to help our clients:

LIAT (1974) Ltd. v. Mark Armstrong (2007);

On behalf of our client, a major Caribbean airline, we were able to effectively recover a disputed domain name that had been acquired by a cybersquatter nearly 10 years earlier. Further, we were able to overcome the fact that our client did not hold a registered trademark; this despite having been in business for more than 50 years.

Lancaster Vineyards Inc. v. Max Davidovich (2006);

We helped an elite California winery recover its principal domain name against a notorious cybersquatter.

Dreamgirls, Inc. v. Dreamgirls Entertainment (2006);

We successfully defeated a U.S. registered trademark holder from acquiring our client’s domain name. Despite owning a legitimate trademark registration, the opposing party failed to appreciate that other factors, such as the relative strength of the trademark, are key in determining domain name ownership issues.

BC Fax It Limited v. It's The Fax Ltd. a/k/a It's The Fax c/o Ryan Galovich (2005)

Our client was victimized by a local competitor who had registered our client’s business name as a domain name. Having registered the domain name, the competitor was using it to redirect customers to his own competing website. By properly asserting our client’s unregistered trademark rights, we were able to recover the domain name.

We invite you to spend some time navigating our website. While we encourage you to contact us should our services be attractive to you, we have also designed our site with the express purpose of educating prospective clients about legal issues related to trademarks and the Internet.
